The law is plain: any charges banks levy on their customers must be proportional to the actual costs they incur - not penalty charges.  The simple question is, ‘does it really cost £35 to send an automated letter when someone’s gone 1p over the limit?’

 

LATEST INFORMATION on OFT TEST CASE - 27th April 2008

 

A judge has decided that the Office of Fair Trading (OFT) can apply consumer contract regulations to decide if bank overdraft charges are fair or not.
 
But more hearings are expected which will delay the cases of claimants, who should not expect an automatic pay-out.
 
Cases currently on hold in the county courts will stay on hold until the end of May, when the banks will decide whether they are going to appeal against the ruling.
 
Mr Justice Andrew Smith said his judgement, "does not necessarily mean they [the charges] are unfair."  He also decided against the OFT, saying that the banks' terms and conditions were plain and intelligible. This case continues the process which is expected to allow the OFT to decide what a fair charge would be for unauthorised overdrafts.
