is an invoice! A Bank Statement is unusual because it is invariably “paid” or taken out of the bank
account before it is rendered. Therefore, charges are imposed and you only become aware of them sometime after the fact.
Overcharges are
caused for a variety of reasons, but 'penalty rates' are always imposed for unauthorised overdrafts, regardless
of the amount overdrawn.
More recently
the major banks have moved to computerized and therefore, automated calculation of charges. Incidentally it is customers who
have been loyal to their banks who are often are caught out and do not complain, believing it to be their
fault they've gone overdrawn therefore, should not be in a position to claim as the charge is 'in their Terms &
Conditions'. However, although charges are specified in bank terms and conditions - and you probably didn't read them), that’s irrelevant, a contract must be written within the law, and no on can enforce
a with legally unfair terms. Ultimately if it isn't proportionate then it's unlawful, and thus you've a right to your
money back, including interest.
